Adelaide Yoga Flow: Luxurious Ocean Retreat 2027
Terms & Conditions – Amatara Welleisure Resort, Phuket, Thailand
1. Parties
1.1 These Terms & Conditions form an agreement between Sam Efraimsen and Daniel Thyer, trading as Adelaide Yoga Flow (referred to as “Adelaide Yoga Flow”, the “Organisers” or the “Instructors”), and each person who books and/or participates in the Adelaide Yoga Flow Luxurious Ocean Retreat 2027 (the “Retreat”).
1.2 By paying a deposit or making any payment towards the Retreat, the participant acknowledges that they have read, understood and agreed to these Terms & Conditions.
2. Booking & Payment
2.1 A $1,000 non-refundable deposit is required to secure a participant’s place on the Retreat, except where a refund is required under Australian Consumer Law.
2.2 The remaining balance must be paid in full no later than the 1st May 2027.
2.3 If the final balance is not received by the due date, Adelaide Yoga Flow reserves the right to treat the booking as cancelled and offer the place to another participant.
2.4 Payment may be made via bank transfer.
2.5 Payment plans may be available upon request. Unless otherwise agreed in writing, the full Retreat balance must still be received by the final payment due date.
3. Cancellation by a Participant
3.1 All cancellations must be made in writing to Adelaide Yoga Flow.
3.2 The $1,000 booking deposit is non-refundable, except where otherwise required under Australian Consumer Law.
3.3 If a participant cancels before the 1st May 2027, payments made in addition to the $1,000 deposit will be refunded, less any non-recoverable costs already incurred or committed by Adelaide Yoga Flow on the participant’s behalf.
3.4 If a participant cancels after 1st May 2027, payments made are non-refundable, as accommodation, venue, activity and other Retreat costs may already have been committed to suppliers.
3.5 If Adelaide Yoga Flow is able to fill the cancelled place with another participant, Adelaide Yoga Flow may, at its discretion, refund amounts that are able to be recovered as a result of the replacement booking, less the non-refundable deposit and any administration fees or non-recoverable costs.
3.6 No refunds or credits will be provided for late arrival, early departure, missed activities, illness, injury, changes in personal circumstances or any unused portion of the Retreat, except where required by law.
3.7 We strongly recommend that participants purchase comprehensive travel insurance at the time of booking to protect against cancellation due to illness, injury, travel disruption and other unforeseen circumstances.
4. Cancellation or Changes by Adelaide Yoga Flow
4.1 If Adelaide Yoga Flow cancels the Retreat for reasons within its reasonable control, participants will be offered a refund of payments made or, where agreed, the option to transfer payments to a future Adelaide Yoga Flow retreat.
4.2 Adelaide Yoga Flow reserves the right to make reasonable changes to the Retreat where necessary, including changes to the schedule, activities, excursions, dining arrangements, instructors or other aspects of the Retreat.
4.3 Where a significant change is required, Adelaide Yoga Flow will endeavour to communicate this to participants as soon as reasonably possible.
5. Events Beyond Our Reasonable Control
5.1 In the unlikely event that the Retreat is cancelled, postponed, rescheduled or otherwise significantly affected by circumstances beyond Adelaide Yoga Flow’s reasonable control — including, but not limited to, natural disasters, severe weather events, government restrictions, pandemics, travel bans, airline disruptions, political unrest, civil disturbance or other force majeure events — Adelaide Yoga Flow will make every reasonable effort to provide an appropriate alternative.
5.2 This may include rescheduling the Retreat, modifying the Retreat arrangements or offering a credit towards a future Adelaide Yoga Flow retreat.
5.3 Refunds may be reduced or unavailable where payments or costs have already been committed to accommodation providers, venues, transport providers, activity providers or other suppliers and cannot reasonably be recovered.
5.4 Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies available to participants under Australian Consumer Law.
5.5 Comprehensive travel insurance is strongly recommended to cover cancellation, delays, travel interruptions, medical emergencies and other unforeseen circumstances.
6. Travel & Transport
6.1 Participants are responsible for arranging and paying for their own flights to and from Phuket.
6.2 Airport transfers and other transport are included only where specifically stated in the Retreat inclusions.
6.3 Participants are responsible for ensuring that they hold a valid passport and any visas, entry permissions, travel documentation or other requirements applicable to their travel.
6.4 Adelaide Yoga Flow is not responsible for flight cancellations, delays, missed connections, airline schedule changes or other travel disruptions outside its reasonable control.
6.5 Any additional accommodation, transport, meals or other expenses arising from travel delays or changes are the participant’s responsibility unless otherwise required by law.
7. Travel Insurance
7.1 Participants are strongly encouraged to purchase comprehensive travel insurance as soon as their Retreat booking is confirmed.
7.2 Travel insurance should, where appropriate, include cover for:
- cancellation and trip interruption;
- overseas medical and hospital expenses;
- illness or injury;
- flight cancellation or delay;
- baggage and personal belongings; and
- other unforeseen circumstances that may affect participation in the Retreat.
7.3 It is the participant’s responsibility to ensure that their chosen insurance policy provides suitable cover for their individual circumstances and the activities they intend to participate in.
8. Health, Wellbeing & Participation
8.1 Participants are responsible for advising Adelaide Yoga Flow prior to the Retreat of any relevant injuries, medical conditions, allergies or other health concerns that may reasonably affect their ability to participate safely.
8.2 Yoga, movement, excursions and other Retreat activities may involve physical activity and carry inherent risks.
8.3 Participants are responsible for determining whether an activity is suitable for them and should seek appropriate medical advice before participating where necessary.
8.4 Participants are encouraged to listen to their bodies, practise within their own limits and advise the Instructors of any concerns, injuries or limitations.
8.5 Participation in any yoga class, excursion, activity or other Retreat offering is voluntary.
9. Liability
9.1 Participants acknowledge that travel, yoga, physical activity, excursions and other Retreat experiences may involve inherent risks.
9.2 To the extent permitted by law, Adelaide Yoga Flow will not be responsible for loss, damage, delay, additional expense, illness or injury.
9.3 Participants are responsible for taking reasonable care of their own health, safety, belongings and personal property throughout the Retreat.
9.4 Adelaide Yoga Flow is not responsible for the loss, theft or damage of personal belongings.
9.5 Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under Australian Consumer Law.
10. Accommodation
10.1 Accommodation will be provided according to the room type and package selected at the time of booking.
10.2 Participants sharing accommodation are responsible for ensuring that the selected arrangement is suitable for them.
10.3 Any additional nights booked before or after the official Retreat dates are separate from the Retreat package unless specifically arranged through Adelaide Yoga Flow at an additional cost.
10.4 Participants are responsible for any additional charges incurred personally at the resort, including room service, additional food and beverages, minibar purchases, spa treatments or other services not specifically included in the Retreat package.
11. Meals & Dietary Requirements
11.1 Meals and dining experiences included in the Retreat are those specifically outlined in the published Retreat inclusions.
11.2 Participants must advise Adelaide Yoga Flow of any food allergies, intolerances or dietary requirements prior to the Retreat.
11.3 Adelaide Yoga Flow and its suppliers will make reasonable efforts to accommodate dietary requirements but cannot guarantee that food will be completely free from allergens or traces of particular ingredients.
11.4 Additional meals, drinks and alcoholic beverages that are not specifically included in the Retreat package are the participant’s responsibility.
12. Retreat Activities & Excursions
12.1 Retreat inclusions may include yoga, meditation, breathwork, wellness experiences, excursions, workshops, dining experiences and other group activities as outlined in the Retreat itinerary.
12.2 Participation in individual activities is optional.
12.3 Adelaide Yoga Flow reserves the right to substitute, modify or cancel an activity where reasonably necessary because of weather, availability, safety considerations, supplier changes or other circumstances beyond its reasonable control.
12.4 Where possible, an appropriate alternative activity or arrangement will be provided.
12.5 No refund will ordinarily be provided where a participant chooses not to take part in an included activity or excursion.
13. Conduct & Participant Responsibilities
13.1 Participants are expected to behave respectfully towards fellow guests, Adelaide Yoga Flow instructors, resort staff, local providers and members of the local community.
13.2 Behaviour that is disruptive, abusive, unsafe, discriminatory, threatening or otherwise inappropriate may result in a participant being asked to leave an activity or the Retreat.
13.3 Where a participant is required to leave the Retreat due to serious inappropriate behaviour, no refund will ordinarily be provided for the unused portion of the Retreat.
13.4 The possession or use of illegal substances is strictly prohibited.
14. Photography & Media
14.1 Photographs and video may be taken during the Retreat to capture the Retreat experience and may be used by Adelaide Yoga Flow for its website, social media and other promotional purposes.
14.2 Participants who do not wish to appear in promotional photographs or video are asked to advise Adelaide Yoga Flow prior to the commencement of the Retreat.
14.3 Adelaide Yoga Flow will make reasonable efforts to respect any participant’s request not to be photographed or filmed for promotional purposes.
15. Personal Information
15.1 Personal information provided by participants will be used where reasonably necessary to administer the Retreat, manage bookings and communicate relevant Retreat information.
15.2 Health, dietary and emergency information may be shared with relevant Retreat providers where reasonably necessary for a participant’s safety or to provide the requested service.
16. Governing Law & Jurisdiction
16.1 These Terms & Conditions are governed by the laws of South Australia.
16.2 Each participant submits to the non-exclusive jurisdiction of the courts of South Australia in relation to any dispute arising from these Terms & Conditions.
17. Acceptance of Terms
17.1 Payment of the Retreat deposit constitutes acceptance of these Terms & Conditions.
17.2 Participants are encouraged to read these Terms & Conditions carefully before confirming their booking and to contact Adelaide Yoga Flow with any questions prior to payment.
